The Functions of the President of the Republic

First: The issues which the President of the Republic decides about:

The President of the Republic represents the Government and the Supreme Commander of the People's Armed Forces, the Police and the Regular Forces. He, likewise, maintains the security of the country, away from dangers, preserving its pride and dignity, sustain its external relations, sustains the path the judiciary and justice and public morals, the patron of the Constitutional Institutions and urges on the advancement of the country.

For this, he shall have the following functions and powers, according to the Constitution and the law:-

1- The appointment of the occupants of the national constitutional positions.

2- The premiership of the Council of Ministers.

3- The right to initiate the constitutional amendments, national legislations and signing them.

4- Approval of the judgements of the death penalty, granting pardon and the cancellation of conviction of penalty.

5- The representation of the State, in its foreign relations with other states, the international organizations, the appointment of the ambassadors of the State and approving the foreign ambassadors.

6- The general representation of the power of the State and the people's will, in front of the public opinion, in the public occasions.

7- The appointment of the higher executive leadership, in the public service.

8- Any other functions set in the Constitution or the law.

Second: the issues in which the President takes decisions, by agreement with the First Vice President:

1- The declaration and ending – up of the state of emergency (Articles 210 and 212) of the Constitution.

2- Declaration of War (Article 213 of the Constitution).

3- Calling the Legislative Body to meet, adjournment of its sittings or suspending them, according to Article 58 (1) (e) of the Constitution.

4- The determination of the size of the Sudanese Armed Forces, in Southern Kordofan and the Blue Nile Sates, during the Transitional Period (Item 10-1 of Southern Kordofan and the Blue Nile Protocol) (Article 182 of the Constitution.)

Third: The establishment of the Commissions, the apparatuses and the appointments which the President of the Republic makes, by the consent of the First Vice – President:

1- The establishment of a special Commission for the guarantee of the rights of non-Muslims, in the National Capital (Article 157 of the Constitution.)

2- The establishment of the National Elections Commission (Article 141 (1) n, 5 (2) (C) of the Constitution).

3- The establishment of the Human Rights Commission (Article 142 of the Constituion.)

4- The establishment of the National Commission for Judiciary Service (Article 129 of the Constitution.)

5- The establishment of the National Commission of the Civil Services (Article 137 of the Constitution.)

6- The establishment of a specialized Committee, for the follow-up and the guarantee of the legality exactitude and transparency in the referendum (Article 220 of the Constitution.)

7- The establishment of a Commission for the Allocation and Supervision of the financial revenues (Article 198 of the Constitution.)

8- The appointment of the Chief Justice of the Constitutional Court (Article 120 of the Constitution.)

9- The appointment of the other Judges, save for the Judges of the Constitutional Court (Article 130 of the Constitution.)

10- The appointment of the Judges of the Constitutional Court (Article 121 of the Constitution.)

11- The appointment of Judges of the National High Court (Article 130 of the Constitution.)

12- The establishment and appointment of the National Commission for the Revision of the Constitution (Article 140 of the Constitution.)

13- The appointment of the Joint Defence Council (Article 146 of the Constitution.)

14- The appointment of the Chairman of the National Lands Commission (Article 187 (3) of the Constitution.)

15- The establishment of the National Petroleum Commission (Article 191 of the Constitution.)

16- The recruitment and appointment of the Chairman of the Allocation and Supervision of the Financial Revenues (Article 198 (4) of the Constitution.)

17- The establishment and recruitment of the officials of the National Audit bodies (Article 205 of the Constitution.)

18- The appointment of the Governor of the Central Bank of the Sudan, and his Deputy. (Article 202 (6) of the Constitution.)

19- The appointment of the Board of Directors of the Central Bank of Sudan, which shall be responsible to the Presidency (Article 202 (4) of the Constitution.)

20- The establishment of an independent Commission for the assessment, evaluation and execution of the Comprehensive Peace Agreement (CPA), in South Kordofan and the Blue Nile States (Item 3-4 of South Kordofan and Blue Nile States Protocol). Article 182 of the Constitution).

21- The appointment of the Executive Council of Abyie Region (Items 2-2 and 2-2-1 of Abyie Protocol) (Article 182 of the Constitution.)

22- The appointment of the Senior of the Administrators, at Abyie Region, and his Deputy. (Item 4-2 Abyie Protocol) Article 182 of the Constitution.)

23- The appointment of the Members of Abyie Regional Council (Item 4-5 of Abyie Protocol) (Article 182 of the Constitution.)

24- The establishment of Abyie Frontiers Commission (Item 1-5 of Abyie Protocol) (Article 182 of the Constitution.)

25- The establishment of Abyie Referendum Commission (Item 1-8 of Abyie Protocol) (Article 182 of the Constitution.)

26- Establishment of any other Commission, according to what the two parties agree upon (Item 7-1-10-2 of the Power Protocol).

27- The establishment of an independent Commission for Assessment and Evaluation. (Article 221 of the Constitution.)

28- Any other appointments which may be agreed upon, by the two parties of the Constitution.

Fourth: The appointments which are made; through Consultation with the Presidency of the Republic:

1- The appointment of the Governors (Walis) of South Kordofan and the Blue Nile State (The Agreement), (Article 182 of the Transitional Constitution).

2- The appointment of the occupants of the Constitutional Post, in the National Unity Government (Article 70 (1) of the Transitional Constitution).

Fifth: The issues decided by the Presidency, after consultation:

1- The determination of the Executive, Legislative and Financial Authorities and Powers, at Abyie Region (Item 6-2 Abyie Protocol) Article 182 of the Transitional Constitution.)

2- Request to the Judiciary, to establish courts at Abyie Region, whenever it is deemed suitable (Item 7-2 of Abyie Protocol) (Article 182 of the Transitional Constitution.)

3- Approving the Special Account of Abyie Region (Item 5-3 of Abyie Protocol) (Article 182 of the Transitional Constitution.)

4- The implementation of the Administrative Status of Abyie (Item 3-5 of of Abyie Protocol), (Article 182 of the Transitional Constitution.)

5- The determination of the representation of the citizens of Abyie Region, in a suitable way, in Bahr el-Ghazal State and South Kordofan State (Item 2-6 of Abyie Protocol); (Article 182 of the Transitional Constitution.)

6- Approving the budget of the National Lands Commission (Article 187 (4) of the Transitional Constitution.)
